These Terms of Service (“Terms”) govern your use of the Tiny Amber mobile application and related services (collectively, the “Service”). By using Tiny Amber, you agree to these Terms.
If you do not agree, do not use the Service.
1. Provider
The Service is provided by Vibrant Storms (eenmanszaak) (“Tiny Amber”, “we”, “us”, “our”).

2. Eligibility
You must be at least 16 years old (or the minimum legal age in your country) to create an account and use the Service. If you use the Service on behalf of someone else, you confirm you have authority to accept these Terms.
3. The Service and important disclaimers
Tiny Amber helps parents and caregivers track routines and daily care, including sleep, feeding, diapers, solids, medicine, growth, and notes.
No medical advice. Tiny Amber does not provide medical advice, diagnosis, or treatment. If you have concerns about health, development, medication, allergies, or emergencies, consult a qualified professional.
No guarantees. We do not guarantee the Service will be uninterrupted, error-free, or that it will meet your needs. We may modify, suspend, or discontinue parts of the Service at any time.
4. Accounts
Some features require an account. You agree to provide accurate information and keep your login credentials secure. You are responsible for all activity under your account.
We may restrict, suspend, or terminate accounts that violate these Terms or applicable law.
5. Your content and responsibilities
You are responsible for the information you enter into the Service, including child profile data and logs (“User Content”). You confirm you have the right to enter and process this information, including where it relates to a child.
You agree not to:
Use the Service for unlawful purposes
Interfere with or disrupt the Service or security
Attempt to reverse engineer, decompile, or bypass protections except where permitted by law
Use the Service to store or transmit malware
6. Offline use and cloud features
Tiny Amber is designed to work offline. Premium features may allow cloud backup and family sharing. If enabled, relevant data is synced to cloud providers to support backup, restore, and collaboration.
Cloud features may require internet access and may not be available in all regions.
7. Subscriptions, billing, and renewals
Tiny Amber may offer paid subscriptions (“Premium”). Subscriptions are processed by Google Play and governed by Google’s billing terms and policies.
Key points:
Payment is charged to your Google Play account at confirmation of purchase.
Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
You can manage or cancel your subscription in the Google Play Store under Payments & subscriptions → Subscriptions.
Price changes, trials, and offers (if any) follow Google Play rules.
Refunds. Refund requests are handled by Google Play unless applicable law requires otherwise. We do not process refunds directly for purchases made through Google Play.
8. Intellectual property
The Service, including software, designs, text, and branding, is owned by Vibrant Storms or its licensors and is protected by intellectual property laws.
We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial use, subject to these Terms.
You may not copy, modify, distribute, sell, lease, or create derivative works from the Service except as permitted by law.
9. Third-party services
The Service may rely on third-party services such as Google Firebase, Google Play Billing, and RevenueCat. Your use of those services may be subject to their terms and policies. We are not responsible for third-party services outside our control.
10. Privacy
Our Privacy Policy explains how we process data. By using Tiny Amber, you agree to the processing described there.

11. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available”. We disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of liability
To the maximum extent permitted by law:
Vibrant Storms will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, goodwill, or business interruption.
Vibrant Storms’ total liability for any claim arising out of or related to the Service will not exceed the amount you paid for Premium in the 12 months before the event giving rise to the claim, or €20, whichever is greater.
Some jurisdictions do not allow certain limitations, so these limits may not apply to you.
13. Indemnity
To the maximum extent permitted by law, you agree to indemnify and hold Vibrant Storms harmless from claims, liabilities, damages, and expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.
14. Termination
You may stop using the Service at any time. You can delete your account in the app or via:

We may suspend or terminate access if you violate these Terms or if required for security or legal reasons.
Termination does not automatically cancel your Google Play subscription. You must cancel through Google Play.
15. Changes to the Service or Terms
We may update the Service and these Terms. If changes are material, we will provide notice within the app or via the website. Continued use after changes means you accept the updated Terms.
16. Governing law and disputes
These Terms are governed by the laws of the Netherlands, excluding conflict of law rules.
If you are a consumer in the EU/UK, you may also have mandatory rights under your local consumer laws and you may bring claims in your country of residence where applicable.
Unless mandatory consumer law provides otherwise, courts in the Netherlands will have jurisdiction over disputes.
